COURT GRANTS EX-AGF MALAMI INTERIM BAIL, ADJOURNS CASE TO JANUARY 5, 2026

A Federal Capital Territory (FCT) High Court in Abuja has granted interim bail to former Attorney-General of the Federation and Minister of Justice, Abubakar Malami, SAN, in an ongoing case involving the Economic and Financial Crimes Commission (EFCC). The bail ruling was delivered on Tuesday, December 23, 2025, by Justice Bello Kawu of the Abuja Judicial Division. 

Under the court’s order, Malami was granted bail on conditions previously set by the anti-graft agency, including the surrender of his international passport and the provision of two sureties. The sureties approved by the court include the Director-General of the Nigerian Legal Aid Council and a serving member of the House of Representatives representing the Augie/Argungu Federal Constituency. 

Justice Kawu reaffirmed and reactivated the bail conditions that had initially been fulfilled on November 28, 2025, before Malami’s detention. The judge said the interim bail was justified on the grounds of exceptional hardship while the substantive motion on notice a formal legal challenge in the matter is pending before the court. 

The case has now been adjourned to January 5, 2026, when the court will hear arguments on the motion on notice and determine the next phase of the legal proceedings against the former attorney-general. 

Malami has been the subject of an EFCC investigation into alleged corruption and related offences. Earlier reports indicated that the anti-graft agency was probing him over various alleged offences, including money laundering and abuse of office. Although Malami has denied many of the claims, his detention and the need to meet bail conditions had complicated his legal situation prior to this court order.
