South Korea has brought an expanded espionage law into effect, significantly broadening the definition of espionage as Seoul intensifies efforts to protect sensitive technologies and strengthen the security of its strategically important semiconductor industry.
The revised law, which took effect on September 13, expands the scope of espionage offences beyond activities connected primarily to North Korea to include the transfer or acquisition of sensitive information involving foreign countries more broadly. The move reflects growing concerns in South Korea that valuable industrial technologies could be obtained by overseas competitors, threatening both national security and the country's economic competitiveness.
For years, South Korea's espionage provisions were largely focused on protecting the country from North Korean intelligence activities. Under the expanded framework, however, acts involving foreign governments or entities can fall within the scope of espionage offences, giving authorities greater legal powers to pursue suspected attempts to obtain sensitive technologies.
The change comes as South Korea seeks to protect its position as one of the world's leading semiconductor powers. Companies such as Samsung Electronics and SK Hynix play a central role in the global supply chain for memory chips and other advanced semiconductor technologies, making their intellectual property increasingly valuable amid intensifying competition between major economies.
The country's semiconductor industry has faced growing pressure from China's rapidly developing technology sector. Although China is not specifically named in the revised espionage law, concerns about Chinese efforts to obtain advanced Korean technology have become an important part of the broader debate over industrial security. South Korean police data showed that around half of detected cases involving leaks of sensitive technology to foreign entities in 2025 were linked to China.
The technology-security issue has become increasingly important as governments around the world compete to control advanced semiconductor manufacturing, artificial intelligence infrastructure and other strategically important technologies. Chips are essential to smartphones, computers, automobiles, telecommunications equipment, artificial intelligence systems and modern military technologies.
South Korean authorities have therefore been under increasing pressure to strengthen protections for domestic companies while preventing highly trained workers and corporate insiders from transferring valuable information to competitors overseas.
The expanded espionage law is part of that wider effort. By extending the legal definition of espionage, Seoul aims to close what officials and industry groups have regarded as a significant weakness in the previous system, under which certain technology transfers involving countries other than North Korea could be treated primarily as industrial-technology theft rather than espionage.
The distinction is important because espionage offences can carry much more serious national-security implications and penalties. The broader law is intended to give prosecutors and investigators stronger tools when dealing with cases in which foreign interests are suspected of deliberately obtaining strategic information.
South Korea's action also comes at a time when semiconductor technology has become increasingly intertwined with geopolitical competition. The United States, China, South Korea, Taiwan, Japan and European countries have all introduced measures designed to secure critical supply chains, attract semiconductor investment or restrict access to sensitive technologies.
South Korea's semiconductor companies are particularly exposed to these tensions because their technologies and production capabilities are crucial to global electronics and artificial-intelligence industries. Samsung and SK Hynix have also been expanding their cooperation with international technology companies as demand for advanced memory chips increases.
Recent developments in the artificial-intelligence sector have further increased the strategic importance of South Korean semiconductor technology. OpenAI, for example, has been expanding its relationship with Samsung around next-generation chip development and AI-related services, while Samsung and SK Hynix remain major suppliers of advanced memory products needed for AI computing.
The new law could therefore have consequences extending beyond traditional national-security investigations. Companies may face greater scrutiny over how employees, contractors and business partners handle proprietary information, particularly when sensitive technology is transferred across borders.
At the same time, South Korea will need to balance stronger national-security protections with legitimate international business activity. The country's semiconductor industry operates through highly interconnected global supply chains, research partnerships and overseas manufacturing and investment arrangements.
The legislation highlights how governments are increasingly treating advanced technology as a national-security asset rather than simply a commercial product. In South Korea's case, protecting semiconductor expertise has become closely connected to protecting the country's economic strength and strategic position.
The move is also likely to be closely watched by other technology-producing countries facing similar concerns over industrial espionage. As competition over artificial intelligence, advanced chips and other critical technologies intensifies, governments are increasingly seeking legal mechanisms that can prevent foreign actors from acquiring sensitive information.
For South Korea, the immediate challenge will be ensuring that the expanded law is applied effectively while maintaining clear legal standards for distinguishing legitimate international business from unlawful intelligence-gathering or technology theft.
The implementation of the law marks a significant shift in Seoul's approach to espionage and industrial security. By extending protection to sensitive information involving foreign countries generally, South Korea is signaling that the threat to its strategic technologies is no longer viewed solely through the lens of North Korea, but as part of a much broader global competition over technological power.
